GENERAL CONTRACT AND TRAVEL CONDITIONS OF ALTAY REISEN GMBH
1. Conclusion of contract
1.1. The contract between you and Altay Reisen GmbH comes into effect with the unconditional acceptance of your written, telephone or personal registration at your booking office. From this point in time, the rights and obligations under the contract (including these general contract and travel conditions) become effective for you and Altay Reisen GmbH. If you register other travel participants, you are liable for their contractual obligations, in particular for paying the travel price. The contractual obligations apply to all participants. For flight-only arrangements, the general contract and travel conditions of these airlines apply, which can be stricter.
If you are provided with travel arrangements or individual services by other tour operators or service providers through the booking office or via one of our websites, we are not contractual partners, but merely agents, and their own contract and travel conditions apply. The contract and travel conditions as well as the liability limitation apply to additional mediated transport services (flight tickets, boat, train and bus tickets, vehicle rental, etc.) as well as to all other services provided by third parties. nk of the respective transport company, service provider or rental company. In all these cases, our service as an agent is limited to arranging for you the services offered by third parties (tour operators, transport companies and other service providers) in accordance with your order for a fee (order flat rate and agency commission). Our own service is limited in these cases to the obligatory mediation of the corresponding contract and, if you have the appropriate power of attorney, to its conclusion in your name. In these cases, we assume no liability for the services provided by the third parties. Before we execute your order, we will contact you regarding payment terms. We can only carry out your booking once your payment has been secured. The prices and conditions of these third parties as well as the booking status of your order may change during this time until we can definitely execute your order. We assume no liability for these changes.
1.2. Special requests are only part of the contract if they have been accepted by Altay Reisen GmbH and unreservedly confirmed in writing.
2. Prices and terms of payment
2.1. Deposit
The following down payment must be made upon the unconditional acceptance of your booking by the booking office: 20 percent, at least CHF 500.- For bookings with scheduled flight tickets that must be issued immediately, the entire invoice amount must be paid when the order is placed. In the case of an early booking discount, the deposit amount increases. If the deposit is not paid in due time, Altay Reisen GmbH can refuse the travel services and charge the cancellation costs in accordance with sections 3.2.f. claim.
2.2. Final payment
The remaining payment must be received at the booking office no later than 30 days before departure. If it is not done in time, Altay Reisen GmbH can refuse the travel services and charge the cancellation costs according to Section 3.2.f. assert. The documents can only be delivered after receipt of the entire invoice amount.
2.3. Booking fees, expenses for short-term bookings
If you choose ,,land only arrangement” or "Flight Only" want to book, we charge a booking and processing fee.
2.4. Processing fees, cost share of your booking office for advice and reservations
In addition to the prices mentioned in the brochure or on the website, your booking office may charge processing fees and additional cost shares for advice and reservations in accordance with the guidelines of the Swiss Travel Agency Association.
2.5.Credit Cards
The entire travel price can also be debited in individual partial amounts by various service providers.
3. cancellation of the trip by you, assignment of the booking
3.l.General
If you cancel (cancel) the trip or want a change or rebooking of the booked trip, you must inform your booking office personally or by registered letter. The travel documents already received must be returned to the booking office at the same time.
3.2.Handling fee
If your trip is cancelled, changed or rebooked, a processing fee of CHF 120 per order/family will be charged. (see also Section 3.3.)
3.3.Cancellation costs
If you cancel the trip, if you want to make any changes or rebookings, the following cancellation costs will be charged in addition to the processing fees (section 3.2): Up to 40 days before the start of the trip 25% of the travel price, 39-31 days before the start of travel 30%, 30-22 days before the start of travel 40%, 21-16 days before the start of travel 50%, 15-8 days before the start of travel 70%, 7 days before the start of travel up to and including the day of travel 100% of the travel price. Last minute offers and price reduced offers: 100% of the travel price. Deviating cancellation conditions for trips with certain airlines are reserved and will be noted on the reservation confirmation. The receipt of your declaration at the booking office according to Art. 3.1, possibly with all travel documents, is decisive for the calculation of the cancellation or change date; on Saturdays, Sundays and public holidays, the next working day is decisive.
3.4.Package travel with certain scheduled flights
Due to the stricter cancellation conditions of some airlines, their expenses, which can be up to 100%, will be charged in full. Inquire when booking.
3.5. Cancellation cost insurance
In extreme cases, the cancellation costs will be covered by cancellation insurance, provided you have taken out such insurance or it is included in the arrangement. The benefits are based on the applicable insurance policy.
4. Changes in prospectus tenders, price changes, changes in the transport sector
4.1. Changes before the conclusion of the contract
Altay Reisen GmbH expressly reserves the right to change brochure information, service descriptions, prices in the brochures and on the price lists before your booking. If this is the case, inform your booking office about this change before concluding the contract. If charter flights are fully booked on certain dates before the contract is concluded and have to be bought from different service providers at a higher price, the list price will be increased accordingly.
4.2. Price changes after conclusion of the contract In exceptional cases it is possible that the agreed price has to be increased.
Price increases may result from a) subsequent increases in the cost of carriage (including fuel surcharges) b) newly introduced or increased government taxes or fees (such as airport taxes, landing fees, embarkation and disembarkation fees, etc.) c) exchange rate changes or d) price increases imposed by the government (e.g. VAT). If the costs of these travel services increase, they can be passed on to you. The travel price increases accordingly. Altay Reisen GmbH will carry out the price increase no later than 14 days before the start of the trip. If the price increase is more than 10 percent, you are entitled to the costs listed in Section 4.4. mentioned rights.
4.3. Itinerary changes after your booking and before departure.
Altay Reisen GmbH reserves the right, also in your interest, to change the travel program or individual agreed services such as e.g. B. to change accommodation if force majeure, unforeseeable or unavoidable circumstances require it. Altay Reisen GmbH will endeavor to offer you equivalent alternative services and will inform you about such as quickly as possible changes and their impact on the price. Flight time and schedule changes are not considered significant program changes and are dealt with specifically in Art. 6.
4.4. Your rights if the travel price is increased after conclusion of the contract or program changes be made. If you do not send us a message according to letters b) or c), you agree to the price increase, the program change or the change of individual agreed services (the 5-day period is observed if you send your message on 5th day delivered to the post office). Flight time and schedule changes are not considered significant program changes and are dealt with specifically in Art. 6.
5. Trip cancellation by Altay Reisen GmbH
5.1. Cancellation for reasons that are within your control
Altay Reisen GmbH has the right to cancel the trip if you give reasonable cause to do so through your actions or omissions. In this case, Altay Reisen GmbH will pay you back the travel price already paid; further claims are excluded. Cancellation costs according to 3.2.f and other claims for damages remain reserved.
5.2. Minimum number of participants
A minimum number of participants applies to all round trips and blue trips advertised by Altay Reisen GmbH. If fewer than the minimum number of participants take part in a trip, Altay Reisen GmbH can cancel the trip up to 15 days before the specified start of the trip at the latest. Your rights are based on Section 4.4; further claims are excluded.
5.3. Force majeure, strikes
Events of force majeure (e.g. natural disasters, epidemics, civil unrest), official measures or strikes may cause Altay Reisen GmbH to cancel the trip. In such a case, Altay Reisen GmbH will inform you as soon as possible. If the trip is cancelled, Altay Reisen GmbH will endeavor to offer you an equivalent replacement trip. If you take part in this replacement trip, the travel price already paid will be credited to the replacement trip; any price difference will be refunded to you. If you do not take part in the replacement trip, the travel price paid will be refunded to you. Further claims are excluded. (For the formal procedure, see Section 4.4.)
6. Flight time or flight program change
The organizer and the airlines reserve the right even after the conclusion of the contract &amendments the route, the flight plans and the flight times up to the day of departure. Such changes are basically not essential program changes that entitle you to withdraw from the contract, to claim damages or a reduction in the travel price. We cannot accept any liability for flight delays and minimum connection times for connecting flights. If booked catering services (in particular the first dinner) are no longer paid due to a delayed arrival at the destination due to a change in flight times or only provided to a limited extent by the hotel, this does not give rise to any reimbursement claims against Altay Reisen GmbH. The days of arrival and departure are primarily considered to be days of transport and travel, on which no other services are offered apart from accommodation.
7. Sports facilities
Altay Reisen GmbH cannot guarantee that the sports activities listed in the catalog and on the website of the individual hotels can be practiced at any time and without restrictions. Altay Reisen GmbH assumes no liability without written confirmation. Check with your travel agent and consult the price list.
8. Early return
If you break off the trip prematurely for any reason, the price of the travel arrangement cannot be refunded to you. In urgent cases, the Altay tour guide, the local Altay representative or the service provider will assist you as far as possible in arranging the early return journey. You can take out what is known as return travel insurance, which is not included in the travel price. For more information, please contact your booking office.
9. Complaints
9.1. Complaints and Remedial Procedures
If the trip does not correspond to the contractual agreement or if you suffer damage, you are entitled and obliged to notify the Altay tour guide, the local Altay representative or the service provider immediately, ie no later than the following day lack or
to complain about the damage in writing and to demand free remedy.
9.2. The tour guide, the local Altay Reisen GmbH representative or the service provider will endeavor to remedy the situation within the period appropriate to the trip. If no remedy is provided within the period appropriate to the trip, if remedy is not possible or if it is not sufficient, you must confirm the reported defects or the damage and the failure to remedy the situation in writing from the tour guide or the local Altay Reisen GmbH representative ;sign and have it signed. 9.3 If no remedy is provided within the period appropriate for the trip and the defect is not minor, you are entitled to remedy the situation yourself. The you You will be reimbursed for the costs incurred within the scope of the originally agreed trip (hotel category, means of transport, etc.) and against receipt from Altay Reisen GmbH, provided that you have complained about the defect and requested written confirmation (sections 9.1. and 9.2.). 9.4. How to make your claim against Altay Reisen GmbH
If you want to assert defects, refunds or claims for damages against Altay Reisen GmbH, you must submit your complaint together with your possible claim for damages within 30 days after your return by registered letter to Altay Reisen GmbH. Your complaint must be accompanied by the signed confirmation from the tour guide or the local Altay representative and any evidence. If you do not report the defects or the damage according to Section 9, you lose the rights to remedy, self-help, reduction of the travel price, termination of the contract and compensation; forfeit these rights.
10. Liability
The liability of Altay Reisen GmbH is based on Art. 14f PRG. Altay Reisen is not liable for indirect damage. In the case of damage that is not personal injury, Altay Reisen GmbH is liable for a maximum of twice the travel price. Altay Reisen GmbH is not liable if the non-performance or improper performance of the contract is due to negligence on your part, a third party, force majeure or an event which Altay Reisen GmbH despite all due care could not foresee or avert. Altay Reisen GmbH is also not liable for events and excursions at the resort that are booked on site; for loss of valuables, jewelry, cash, etc., flight, tour and other program changes, delays, irregularities, etc.
11. Ticket reconfirmation
When traveling unaccompanied, you are responsible for reconfirming the return flight. Please refer to the travel documents for the necessary information and telephone numbers. Missed reconfirmations can lead to the loss of the right to transport; Any additional costs are at your expense.
12. Flight delays
In the absence of any influence, Altay Reisen GmbH assumes no liability for expenses incurred as a result of flight delays.
13. Entry and visa requirements
The entry documents must be valid for at least 60 days beyond the intended date of stay. Non-Swiss citizens must inform the booking office about their nationality before booking and will be informed about visa and entry regulations upon request when booking. Altay Reisen GmbH accepts no liability for refusal of entry due to non-compliance with visa requirements.
14. Ombudsman
Before going to court, you should contact the independent ombudsman for the travel trade. He strives to reach a fair and balanced settlement of any issues between you and Altay Reisen. The address of the ombudsman is: Ombudsman of the Swiss Travel Industry, PO Box, 8038 Zurich.
15. Governing Law and Jurisdiction
Swiss law is applicable to the legal relationship between you and Altay Reisen GmbH. Actions against Altay Reisen GmbH can only be brought at its registered office in Zurich.
